Provisional listing in the Register of enterprises ineligible for public contracts

The Autorité des marchés publics (AMP) may list a business in the Register of enterprises ineligible for public contracts (RENA) on a provisional basis if its audit finds that the enterprise’s integrity is in doubt. In this case, the AMP may make one of the following decisions:

  1. It may require the enterprise to take specified corrective action within a stated time period.

    If the enterprise fails to implement the required measures, it will be listed in the RENA on a provisional basis until these measures are in place, up to a maximum of three months. During this period, it cannot enter into any new public contracts or subcontracts, but must continue to perform its obligations under contracts in which it is already a party. Note that the Conseil du trésor may oblige a public body to cancel an existing contract with an enterprise in this situation. If the enterprise has still not taken the required corrective action by the end of the additional three-month period, its listing in the RENA will become definitive.

  2. The AMP may definitively list the enterprise in the RENA.
