Oversight and monitoring measures

If an enterprise does not satisfy all integrity requirements, the Autorité des marchés publics (AMP) may impose oversight and monitoring measures, whether or not it has also ordered any corrective action.

These oversight and monitoring measures will ensure AMP supervision of an enterprise that holds a public contract or subcontract in any of the following situations:

  • An integrity audit by the AMP is underway;
  • The enterprise is in the process of implementing corrective action required by the AMP;
  • Its authorization to contract has expired or been suspended; or
  • During the first 60 days after the enterprise has been definitively listed in the Register of enterprises ineligible for public contracts (RENA).

The enterprise must comply at its own expense with the oversight and monitoring measures imposed by the AMP. Failure to do so may result in monetary administrative penalties. The AMP will determine the oversight and monitoring measures in light of the enterprise’s specific situation and may require the enterprise to provide information on the contract or subcontract in progress.
