Complaint process

When individuals or interested businesses believe that tender documents or the process for awarding a contract do not comply with the contractual rules in force, they may file a complaint with the public body concerned or the Autorité des marchés publics (AMP).

Before they file a complaint, complainants are advised to contact the public body to obtain clarification concerning the call for tenders concerned.

Filing a complaint in the required time can affect the process under way such as postponing the deadline for receiving bids to enable the public body or the AMP to conduct the requisite verifications and make a decision.

The provisions respecting complaints also apply to goods certification processes or the qualification of service providers.
